Terms of Service

You open an account with your e-mail address and a 6-digit code we send to it. You keep access to your e-mail account secure and you are responsible for activity on your AmericaBeauty account. You must be 18 or older to open any account. One person may hold one candidate account.

Entry is free at every stage. Eligibility, the ID and age check, photo rules and voting rules are set out in the rules and eligibility, which form part of these terms. You confirm that the information in your entry is true and that you live in the state you enter.

An entry goes public only after your ID document, age and photos pass review. We may decline or remove an entry that breaks the rules, gives false information or harms other candidates or voters, and we tell you the reason by e-mail.

You keep the rights to your photos and texts. You give us a non-exclusive, royalty-free license to show them on americabeauty.com and in our own announcements of the pageant for the edition you enter and for archive pages of that edition. The license ends for new uses when you delete your profile. You confirm that you hold the rights to everything you upload and that every person shown agreed to it.

Each person can vote once per candidate per day. Automated, bought, duplicated or otherwise unfair votes are voided. Offering money, gifts or other benefits for votes leads to removal of the candidate from the edition. Results count valid votes only.

Sponsors buy a subscription for a city, a state, the national title or an own organized contest, as described on the pricing page. Each subscription renews automatically every month or every year, depending on the term chosen at checkout, until you cancel it. A city or state sponsorship is exclusive for the paid period. Sponsor materials (logo, banner, link, offer code) must be lawful, truthful and suitable for a general audience, and we may decline material that is not.

Prices are in US dollars. Sales tax is added where the law requires it. Sponsors receive an invoice for every payment.

Every plan is a recurring subscription and access to the sponsorship is granted in full at the start of each paid period. Payments are therefore final and we do not refund them for a change of mind, an unused period, a renewal you forgot to cancel, the choice of a wrong plan or term, or results that did not meet your expectations.

We refund only in three cases, where the records show it: a duplicate charge for the same period caused by our billing, a proven unauthorized charge reported to us within 14 days, or a total failure of the service that made your sponsorship unavailable for a continuous period which you reported to us and we could not fix. A refund is limited to the amount paid for the affected period and goes back to the original payment method.

To ask for a refund in one of these cases, write to support@americabeauty.com within 14 days of the charge with the date and amount of the payment.

You can cancel at any time in your sponsor account. Cancelling stops the next renewal. Your sponsorship stays active until the end of the period you already paid for and is not prorated. Upgrading to a higher plan or from monthly to yearly billing charges the difference at once.

You may not use the service to harass people, collect data of other users, post unlawful, sexual or misleading content, impersonate another person, interfere with voting or the operation of the site, or use automated tools to access it. We may suspend an account that breaks these rules.

We run the pageant with care, but the service is provided as is. To the extent the law allows, we are not liable for indirect or consequential losses, and our total liability to a sponsor is limited to the amounts paid in the 3 months before the claim. Nothing in these terms limits liability that cannot be limited by law.

We may change these terms. We announce material changes by e-mail at least 14 days before they apply. You can delete your account at any time by writing to support@americabeauty.com or from your account.

These terms are governed by the laws applicable to the administrator of the service, without prejudice to the mandatory consumer protections of the state where you live. Questions about these terms go to support@americabeauty.com.
